Is it possible to trademark a brand name if it's similar to one that exists?


In the United States, the key is determining whether there is a likelihood of confusion. In other words, are consumers likely to believe that the goods are made by the same person. Similarity of the marks is just one factor. Another important factor is the relatedness of the goods. If the goods are wine, for example, and you want to use a similar mark on a wine, then there would be a greater likelihood of confusion. If, however, the goods are orthopedic shoe inserts, then the likelihood of confusion is greatly reduced because few people would think that a winery made orthotics.

There is an exception for famous marks because they are so strong. For example, if you saw a bar of APPLE soap, you might not think that APPLE has gone into the soap business, but you might think of Apple computers or products. That is called “trademark dilution” because it is likely to diminish the value of the APPLE trademark. In that case, likelihood of confusion has nothing to do with the analysis.

Can I trademark a name that is similar (but not identical) to the name of another company?

If you will use it on completely different products, then yes, it might be possible. For instance, they produce milk and you offer tires. The main idea is to avoid confusion between your brands; since if a regular customer thinks that your products and the company’s products originate from the same source, you will be in trouble.


If the products are similar (even if they are not identical), you should think about choosing another trademark. In the US the company has some common law rights, provided that they used the trademark first. If it’s just a company with the same name and they do not use the name in commerce, it does not qualify for the protection. If the name is in use, the owners can try to cancel your registered trademark if you register it.

The cancellation will be expensive, very expensive and if your trademark becomes popular and the regular customer associates the trademark with your products, they may fail to succeed.

Facts to check: are they using the unregistered trademark? On what products are they using it? Are they similar to your products? Is the trademark registrable?
                                            
You can try to apply for your trademark if it’s registrable and not in use. No one can guarantee that it registers, however, it might be worth trying.

How exactly does registered trademark law works?


Intellectual property rights are territorial. American trademarks, patents and copyrights, therefore, do not confer protection on their owners in Europe if the IP owner has not registered their product with your nation’s patent office. The sole exception to this rule involves trademark applications filed under the Madrid Protocol. This system permits American business owners to submit trademark applications that protect their mark in the United States and other designated nations. If the trademark owner in your case did submit such an application and paid for IP protection in your country, you would be prohibited from using the mark.



Finally, I would strongly encourage you to research whether this comic book trademark is protected intellectual property in Europe. I say this only because the registered trademark symbol ‘(®)’ can denote a trademark in a country other than the United States. The comic book image could, for instance, be a registered trademark in Vietnam. You do not want to inadvertently violate any IP laws.

Is it necessary to register the trademark of my open source project?

When Shall Trademark Right is Generated and Established?


Mark is one of subject matters of industrial property rights under Vietnam Intellectual Property Law (Vietnam IP Law).  Mark means any signs used to distinguish goods or services of different organizations or individuals. 


According to Article 6 of Vietnam IP Law, industrial property rights to mark shall be established on the basis of a decision of the competent State body to grant a protection title in accordance with the registration procedures stipulated in Vietnam IP Law or the recognition of international registration pursuant to an international treaty of which the Socialist Republic of Vietnam is a member.
